These general terms and conditions apply between:
BBTEX, 31 avenue de Ségur 75007 Paris, with a share capital of €15,000.00, registered in the Paris Trade and Companies Register under number 534 515 985 , 534 515 985 000 33, hereinafter referred to as "the COMPANY" and any natural person visiting and/or making a purchase via the www.cottonco.fr website, hereinafter referred to as "the Internet user"
These general conditions of sale apply exclusively to online purchases made by the Internet user within the framework of the regulations applicable to distance selling (articles L 121-16 to L121-20 of the Consumer Code) incorporating Directive 97/7 EC of 20 May 1997 on the protection of consumers in respect of distance contracts.

Use of the distance selling process described in these general terms and conditions of sale is reserved for consumers only. The products are not intended for resale.

By placing an order online, the Internet user expressly and unreservedly accepts these general terms and conditions of sale in their entirety, to the exclusion of all other conditions.

As these general terms and conditions of sale may be subject to change, the terms and conditions applicable are those in force on the www.cottonco.fr website on the date the Internet user places his/her order. Internet users are therefore advised to save and/or print out the general terms and conditions in force on the day they place their order.


ARTICLE 1 - PRODUCT

The website www.cottonco.fr offers household linen and decorative accessories for sale under the Cotton&Co brand. The Products offered for sale are those which appear on the site, on the day of consultation of the site by the internet user and within the limit of available stocks. Special offers are only valid within the double limit of the validity period of the offer concerned and available stocks.

Under no circumstances does the company guarantee that products will remain on sale for a given period.

The products offered for sale are described and presented as accurately as possible. However, the photographs and texts illustrating these products may only be indicative. In any event, the Internet user may refuse the product ordered if there is a difference in conformity between the product delivered and the one described or photographed on the site, and therefore request reimbursement of the sums paid.


ARTICLE 2 - PRICES

Prices are given in Euros, inclusive of all taxes, excluding delivery charges (unless otherwise stated or under special conditions) for all orders delivered in France. Products are subject to French VAT in the country of origin of the Products.

The Company reserves the right to change its prices at any time. Products ordered will be invoiced at the rate in force at the time the order is registered. We may modify the prices indicated on the site at any time and without prior notice. However, the modified prices will only be applied to new orders, with the exception of orders already placed.

ARTICLE 3 - DELIVERIES

The products ordered can only be delivered to the address indicated when the order was placed, once payment has been received.

Products in the same order are, in principle, delivered at the same time unless there are particular problems (unavailability of a product, for example)

Because we want to guarantee you fast, secure delivery, the company has chosen to entrust your parcels to GLS France and Relai Relais. All orders are sent within 24 to 72 hours, except for personalised products.

At the time of delivery, it is the responsibility of the Internet user to check the products delivered (quality, quantity, conformity with the order, etc.). No complaint will be taken into account after the expiry of a period of fourteen days from the date of receipt of the products. A justified complaint made within this period will entitle the user to an exchange or refund of the product, without further compensation.

Some of our products may be available in more than 2 working days. In this case, the period of availability corresponding to the product(s) concerned is indicated on the site. You may order them, but they will only be delivered to you within the times indicated on the site at the time of your order.

The company will do its utmost to deliver the products ordered within the times indicated on the site.
If the deadline is not met and the products ordered are not delivered within thirty days of the conclusion of the contract, the Internet user may choose to cancel the contract.
If, on delivery, the external appearance of the parcel is not perfect, we invite you to open it in the presence of the carrier in order to check the condition of the products delivered. If there is any damage to the products, please give details on the delivery note.

The delivery charge is 6.90 Euros per order.

Transport costs are free for delivery in France for orders of 100 Euros or more to a relay point.

ARTICLE 4 - PAYMENT TERMS

All purchases must be paid for in full before delivery.
Orders are paid for online on the site, by bank card (Carte Bleue, Visa, Eurocard, Mastercard) using the secure electronic payment terminal and Paypal.
The account will only be debited for the amount of the products ordered.
The order will only be validated by the company once the bank server has authorised the transaction.

ARTICLE 5 - TRANSFER OF OWNERSHIP TRANSFER OF RISK

The transfer of ownership of the products ordered is subject to full payment of the price.
The transfer of risk takes place when the Internet user takes physical possession of the goods.

ARTICLE 6 - INTELLECTUAL PROPERTY

All elements of the site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents.

They are the exclusive property of the company.
Any total or partial reproduction, modification or use of these trademarks, illustrations, images and logos, for any reason and on any medium whatsoever, is strictly prohibited.
Any link to the site must be removed on request.
The use of all or part of the site, in particular by downloading, reproduction, transmission or representation for any purpose other than personal and private use for non-commercial purposes, is prohibited.

ARTICLE 7 - LIABILITY - GUARANTEE - RETURNS

The company guarantees that the products delivered comply with current legislation.

However, the performance of all or part of our obligations will be suspended in the event of a fortuitous event or force majeure that hinders or delays their performance.

In the event of a deterioration in the quality of the products, the Internet user must return the products for examination, after having previously obtained a notice of return, by conventional or electronic mail, authorised by the company.

The returned item must not have been used, must be in its original packaging, must not have been unwrapped in the case of bed linen and must be accompanied by a copy of the delivery note and the reason for the return.
Receipt of the products by the company does not constitute recognition of its responsibility.
In the event of the existence of a defect recognised by the company, the internet user may either exchange the product or obtain reimbursement.
In the event of the product being exchanged due to a defect, the shipping costs shall be borne by the company, unless otherwise agreed between the parties.
For obvious reasons of the impossibility of reselling a made-to-measure product to another customer, made-to-measure items (personalised embroidery, for example) may not be returned or exchanged, except in the event of a quality problem.

ARTICLE 8 - RIGHT OF WITHDRAWAL - RETURNS

All products ordered (including promotional products, sales, etc.) may be reimbursed online if returned by post (Colissimo with signature) within the legal withdrawal period, i.e. 14 clear days from the date of receipt of the order, without having to justify the reasons or pay any penalties. If the 14-day period expires on a Saturday, Sunday or public or bank holiday, it is protected until the next working day.

After this period, the products delivered are deemed to be in conformity and accepted by the Internet user, and the company reserves the right to refuse the exchange, credit note or refund.

Returned products must be intact, complete and packaged in their original packaging.

Except in the case of a defect or fault affecting the product, the cost of return will be borne by the internet user.

Products returned by post must be the subject of a request for return by conventional or electronic mail, authorised by the company.
The company will offer the Internet user a credit note corresponding to the total sums paid for the products purchased, valid for 6 months, or a refund of the total sums paid corresponding to the products purchased, without undue delay and at the latest within fourteen days of the date on which it was informed of the Internet user's decision to withdraw.
The company may defer reimbursement until it has recovered the returned products or until the Internet user has provided proof of shipment of the products, whichever comes first.

ARTICLE 9 - PERSONAL DATA

The company keeps an electronic file which records certain personal data relating to users of its site, in compliance with legislation on the protection of personal data.

This information is used, in particular, to fulfil Internet users' orders, to facilitate assistance services and to respond more effectively to their expectations.

In accordance with the French Data Protection Act of 6 January 1978, as amended by Act no. 2004-801 of 6 August 2004, this website has been registered with the Commission Nationale Informatique et Libertés (CNIL)

ARTICLE 10 - APPLICABLE LAW - DISPUTES

Our General Terms and Conditions of Sale are governed by and subject to French law.

The parties agree that they will attempt to resolve any dispute that may arise as a result of or in connection with the application, interpretation or performance of the sales contract, prior to any legal action.

Failing this, all disputes to which our General Terms and Conditions of Sale may give rise, concerning their validity, interpretation, performance, termination, consequences and consequences, shall be subject to the jurisdiction of the court where the defendant resides or the court of the place of actual delivery of the products delivered or the place of performance of the service.
